Reseal Probate and Letter of Administration
Why do we need to reseal a probate or letter of administration?
When a probate or letter of administration is granted out of Malaysia, and the deceased owns assets in Malaysia (such as a property or a shareholding), it may be necessary for an application to be made to reseal the probate or letter of administration in the Malaysia's High Court before the deceased's estate can be dealt with or distributed to the beneficiaries.
When an application to reseal can be made?
As soon as the original grant of representation of the country where the deceased domiciles has been obtained.
What's the effect where a Probate or Letter of Administration has been resealed?
The probate and letter of administration shall have the like force and effect, and have the same operation in Malaysia, as if it were a grant made by the High Court in Malaysia. Therefore, the executor or the administrator shall have all the rights and obligations as the executor or administrator in Malaysia.
