Estate Administration for Non-Muslim
When a non-Muslim passes away in Malaysia, his estate can be distributed to the beneficiaries by the application of Probate ("Probet") if the deceased passes away with a Will OR Letter of Administration ("Surat Kuasa Mentadbir"), if the deceased passes away without leaving a Will. Both applications can be made through a lawyer or Amanah Raya Berhad ("ARB")
Costs & Fee : ARB vs Lawyer
ARB charges in accordance to the estate value generally. Higher estate value will attract higher costs. The scale of their fees are stated as follows:-
A) 4% on the 1st RM25,000
B) 3% on the next RM225,000
C) 2% on the next RM250,000
D) 1% on the next RM500,000
E) 0.5% on the remaining balance
Illustration:
1) If the estate value is RM 250,000, then the scale fees for estate administration is
RM 7,750. ( 4% x RM 25k + 3% x RM 225k)

If the estate value is RM 500,000, then the scale fees for estate administration is RM 12,750 ( 4% x RM 25k + 3% x RM 225k+ 2% x RM 250k)
3)
If the estate value is RM 1,100,000, then the scale fees for estate administration is RM 17,800 ( 4% x RM 25k + 3% x RM 225k+ 2% x RM 250k + 1% x RM 500k + 0.5% x 100k)
Legal firm charges vary from one law firm to another. You may need to contact law firms for more information about the quotation. Generally, legal fee for Grant of Probate is RM 2,500-3,000 whereas LA's application is around RM 3,500-4,500.
Duration for Estate Administration : ARB vs Lawyer
ARB generally takes 1.5 to 2 years to complete the estate administration depending on the estate's nature.
Legal firm generally takes 4 - 6 months to apply for Probate, and about 9 months to 1 year to apply for LA, depending on the legal firm's expertise in estate administration and the estate's nature.
